JOYNATIVO β JOYNATIVO S.A.S., RUC 0691787377001, Riobamba, Ecuador.
Service Provider β a registered Host (individual or family offering accommodation and cultural activities) or Tutor (language or culture teacher) who has accepted this Agreement.
Traveler β a registered user who books services through the Platform.
Platform β the Joy Nativo website and mobile application at joynativo.com.
Listing β the Service Provider's profile on the Platform, including description, photos, pricing, and conditions.
Tutors and cultural activity providers operating through the Platform may offer lessons and programs as part of an accommodation package or independently. Payouts are made within 5 to 30 business days following the completion of the lesson or activity, provided no dispute is open. The exact timeline depends on the Tutor's country of residence and the transfer method available. Tutors must meet the same verification requirements as Hosts.
The Service Provider receives compensation equal to the booking price less the 15% platform commission. All prices are in USD. Payouts are made within 5 to 30 business days after the Traveler's check-in or completion of the lesson/activity, provided no dispute is open. JOYNATIVO may withhold payouts during active disputes or account suspensions until resolved.
Hosts and Tutors must complete identity verification with a valid government-issued ID. Listings are reviewed for compliance with JOYNATIVO quality standards. JOYNATIVO may conduct audits and request additional documentation. Non-compliance may result in suspension or removal of the Listing.
The Service Provider is solely responsible for obtaining any insurance required by the laws of their country of residence. JOYNATIVO does not provide property, liability, or medical insurance to Service Providers. Service Providers are strongly encouraged to consult a local insurer for appropriate coverage.
Traveler no-show. If a Traveler fails to arrive without prior cancellation, the Host or Tutor is entitled to 50% of the total booking amount (after platform commission). A no-show is confirmed if the Traveler has not contacted JOYNATIVO or the Host within 24 hours of the scheduled arrival or start time.
Early departure. If the Traveler departs early through no fault of the Host confirmed by JOYNATIVO, the Host is entitled to payment for the full originally booked period. Unused nights or sessions are not refunded, unless the accommodation materially failed to match its Listing description.
Host cancellation. If the Host or Tutor cancels a confirmed booking, the Traveler receives a full refund. Repeated cancellations may result in suspension of the Listing.
Force majeure. Neither party is liable for non-performance caused by natural disasters, pandemics, armed conflicts, government travel restrictions, or payment system disruptions. JOYNATIVO will facilitate a full or partial refund or reschedule the booking.
Quality disputes. The Traveler must notify JOYNATIVO in writing within 24 hours of check-in or service start. JOYNATIVO will request evidence from both parties and issue a determination within 5 business days. JOYNATIVO's determination is final.
Each Service Provider appoints JOYNATIVO as its limited payment collection agent solely for the purpose of accepting payments from Travelers on the Service Provider's behalf. Payment made by a Traveler to JOYNATIVO shall be considered the same as payment made directly to the Service Provider, who must provide the booked services as if payment had been received directly. JOYNATIVO will remit to the Service Provider the amounts collected, less the platform commission and applicable adjustments, within the timelines set out in this Agreement.
The Service Provider is an independent contractor and not an employee, agent, or partner of JOYNATIVO. The Service Provider is solely responsible for paying all taxes, duties, and contributions arising from their earnings on the Platform, including income tax, VAT, and self-employment contributions, in accordance with the laws of their country of residence. JOYNATIVO does not act as a withholding agent for the Service Provider, unless expressly required by applicable law.
If a Traveler initiates a chargeback through their bank or payment provider, JOYNATIVO may temporarily hold the chargeback amount from pending payouts to the Service Provider until the dispute is resolved. JOYNATIVO will take reasonable steps to contest unwarranted chargebacks using available booking data, including correspondence, check-in records, and reviews. If the chargeback is resolved in the Traveler's favor, JOYNATIVO may proportionally adjust or withhold subsequent payouts to the Service Provider.
JOYNATIVO is required to comply with applicable anti-money laundering (AML) and know-your-customer (KYC) regulations. Service Providers must provide a valid government-issued identity document, bank account or payment account details for receiving payouts, and any additional information requested by JOYNATIVO. JOYNATIVO may withhold payouts until KYC verification is complete. Providing false or fraudulent documents constitutes a breach of this Agreement and will result in immediate termination and notification of competent authorities.
All payouts are made in USD through payment services available in the Service Provider's jurisdiction, including PayPhone, PayPal, and similar providers. Any currency conversion costs and fees charged by the Service Provider's bank or payment service when receiving funds are borne by the Service Provider. JOYNATIVO is not responsible for transfer delays or failures caused by the receiving bank's restrictions or local regulations.
Accumulated Service Provider compensation is disbursed only when the minimum threshold of USD 20 is reached. Amounts below this threshold are carried over to the next payout cycle. Service Providers can view their current balance through their Platform dashboard.
All Hosts and Tutors must meet JOYNATIVO's safety and quality standards. Key requirements include: functioning emergency equipment (fire extinguishers, first-aid kits, emergency contacts) in residential spaces; disclosure in the Listing of any conditions that may affect the Traveler's safety or comfort (pets, allergens, limited mobility access); and compliance with applicable local regulations, sanitary requirements, and permit obligations. JOYNATIVO reserves the right to remove any Listing that does not meet safety standards without prior notice.
Service Providers agree not to refuse, cancel, or provide inferior service to any Traveler on the basis of race, color, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, or age. Documented cases of discrimination are grounds for immediate and permanent removal from the Platform.
By uploading photos, descriptions, or other content to the Platform, the Service Provider grants JOYNATIVO a non-exclusive, royalty-free, worldwide, sublicensable license to use, reproduce, adapt, publish, translate, and distribute that content for the purposes of operating, promoting, and improving the Platform. The Service Provider warrants that they own or have the right to use all uploaded content and that it does not infringe any third-party rights.
JOYNATIVO reserves the right to immediately suspend an account and freeze pending payouts if there is reasonable suspicion of fraudulent activity, systematic unjustified cancellations, breach of this Agreement, or activities that harm Travelers or the Platform. JOYNATIVO will notify the Service Provider within 24 hours. The Service Provider may submit an appeal; JOYNATIVO will review it within 10 business days.
Either party may terminate this Agreement with 30 days' written notice. JOYNATIVO may terminate immediately without notice in the event of a material breach. Upon termination, JOYNATIVO will pay all confirmed compensation for completed bookings, less any amounts owed to JOYNATIVO or Travelers.
This Agreement is governed by the laws of the Republic of Ecuador. Disputes shall be resolved before the courts of Riobamba. The parties agree to attempt good-faith extrajudicial resolution within 30 days before resorting to litigation.
JOYNATIVO reserves the right to modify this Agreement, the Terms of Use, the Privacy Policy, and any fees, payout timelines, or other conditions at any time. For material changes, JOYNATIVO will notify Service Providers at least 14 days in advance. Continued use of the Platform constitutes acceptance of the updated terms.
This Agreement is published in English, Spanish, and Russian. In the event of any discrepancy between language versions, the Spanish version shall prevail.
